Terms of Use.

These terms govern your use of FakeTraffic — the website, newsletter, and podcast. By accessing any of them, you agree to these terms. If you don't, please don't use the service. Short version: read freely, share generously, don't break the law, and don't sue us over the things the law wouldn't let you anyway.

Acceptance of these terms.

By accessing or using FakeTraffic, you confirm that you've read, understood, and agreed to these terms and our Privacy Policy. If you're accepting on behalf of a company, you represent that you have authority to do so.

Who we are.

FakeTraffic ("we," "us," "our") is an independent publication covering data contamination, audience inflation, and the claims that go un-audited across programmatic advertising. We are reader-supported and accept no revenue from the suppliers we cover.

Use of the site.

Subject to these terms, we grant you a limited, non-exclusive, non-transferable, revocable license to access and read the site for personal, non-commercial use, and for legitimate editorial, academic, and professional reference.

You may:

You may not:

Intellectual property.

All content on FakeTraffic — articles, images, podcasts, data visualizations, the brand, and this website's design — is owned by FakeTraffic or its licensors and is protected by copyright, trademark, and other intellectual-property laws.

"FakeTraffic" and related marks are our trademarks. You may refer to us by name in editorial or commentary contexts. You may not use our marks in a way that implies endorsement or partnership.

User conduct.

When interacting with the site, the newsletter, or the tip line, you agree not to:

If you send us a tip, you represent that you have the right to share the information you're sending and that sharing it with us does not violate a binding legal obligation you owe to someone else.

Newsletter & subscriptions.

The FakeTraffic Daily newsletter is currently free. We may introduce paid tiers; if we do, you'll be told in advance and given a chance to opt in.

You can unsubscribe at any time via the link at the bottom of every issue. We may suspend or terminate delivery for any account that we reasonably believe is being used to violate these terms.

Third-party links.

We link to external sources where we can — it's part of showing our work. We don't control those sites and aren't responsible for their content, terms, or privacy practices.

Disclaimers.

Our reporting is journalism, not legal, financial, or investment advice. Audience-supplier assessments we reference (including TrustGrade and similar third-party ratings) are the opinions of their issuers at a point in time and can change. Methodologies evolve.

The service is provided on an "as is" and "as available" basis. To the fullest extent permitted by law, FakeTraffic disclaims all warranties, whether express, implied, or statutory, including warranties of merchantability, fitness for a particular purpose, accuracy, and non-infringement.

Limitation of liability.

To the fullest extent permitted by law, FakeTraffic, its staff, contributors, and affiliates will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenue, data, or goodwill, arising out of your use of (or inability to use) the service.

Our total liability to you for any claim arising under or related to these terms will not exceed the greater of (a) the amount you paid us in the twelve months before the event giving rise to the claim, or (b) one hundred U.S. dollars.

Some jurisdictions do not allow the exclusion or limitation of certain damages. To the extent those limits apply to you, the above limitations apply only to the maximum extent permitted by law.

Indemnity.

You agree to defend, indemnify, and hold harmless FakeTraffic and its staff from any claims arising out of your breach of these terms, your misuse of the service, or your violation of applicable law.

Changes & termination.

We may update these terms from time to time. Material changes will be posted to this page and, where appropriate, announced in the newsletter. Continued use of the service after changes take effect means you accept the updated terms.

We may suspend or terminate access to the service, in whole or in part, at any time, with or without notice, for any reason.

Governing law.

These terms are governed by the laws of the State of New York, without regard to its conflict-of-laws principles. Any dispute that cannot be resolved informally will be brought exclusively in the state or federal courts located in New York County, New York.

Contact.

The short version, again: Read us. Quote us. Cite us. Don't scrape us for AI training, don't republish whole pieces without asking, and don't sue us because a supplier didn't like what we published.
